LEGAL
Terms of service
The terms on which TARISA supplies verification, inspection and monitoring services.
Draft — not yet in force. These terms are being finalised with Zimbabwean legal advice before launch. In the meantime, every engagement is governed by the written scope you approve before work begins, which states what will be checked, what will not, who will do it, the fee, the turnaround target and the limitations.
The positions that will not change
Whatever form the final drafting takes, these are commitments rather than drafting choices, and they will appear in the finished terms.
- The written scope governs. What we agreed to check is what we are responsible for checking.
- TARISA is not a regulated professional. We are not an estate agent, and we do not act as a registered engineer, architect, quantity surveyor, land surveyor or legal practitioner. We coordinate appropriately registered professionals, who sign their own opinions.
- We do not hold client funds. No escrow, no custody, no milestone release — not until a lawful, licensed structure exists and has been approved.
- Verification is not a guarantee. It is not insurance, and it does not warrant a provider’s future conduct, workmanship or completion of a project.
- A check is a point in time. Reports state a reliance period, and who may rely on them.
- We own our failures. Where TARISA omits an agreed check, misreports evidence or fails its own stated method, we investigate, correct or reperform, and apply the contractual remedy.
- Our liability caps will be reasonable and legally reviewed, and they will not attempt to exclude fraud, deliberate misconduct or our own negligence.
- Providers keep correction and appeal rights, and TARISA keeps the right to restrict, suspend or remove a provider with reasons given.
Also to be covered
Concealed and latent defects and unobservable matters · allocation of responsibility between TARISA, the provider, the registered professional and the client · professional indemnity · complaints and appeals procedure · payment terms, disbursements, VAT and cancellation · consumer protection compliance under the Consumer Protection Act [Chapter 14:44] · governing law and dispute resolution.
